Terospik S.A. (hereinafter 'Terospik', 'we', or 'the Company'), with registered address at Av. República del Salvador N34-127 y Suiza, Edificio Platinum, Office 702, Quito, Ecuador, RUC 1792847561001, is committed to protecting the privacy of our users' personal data in accordance with Ecuador's Organic Law on Personal Data Protection (LOPDP) and its current regulations.
1. Data we collect
We collect the following personal data when you interact with our platform: full name, email address, phone number, physical address, financial information necessary to evaluate your investor profile, identification documents (ID card or passport), IP address and browsing data through cookies, and any other information you voluntarily provide through our contact forms.
2. Purpose of processing
We use your personal data to: manage your account and investor profile on the platform; verify your identity in compliance with anti-money laundering regulations; process and manage your investments in real estate projects; send you communications about the status of your investments and relevant updates; comply with legal, tax, and regulatory obligations before Ecuador's Superintendency of Companies, Securities, and Insurance; improve our services and user experience on the platform; and respond to your inquiries and information requests.
3. Legal basis for processing
The processing of your data is based on: your express consent given upon registering on the platform; the execution of the service contract between you and Terospik; compliance with legal obligations established by Ecuadorian legislation; and our legitimate interest in preventing fraud and improving our services.
4. Data transfers
Your personal data may be shared with: Ecuadorian regulatory entities when required by law; technology service providers operating under confidentiality agreements; financial institutions for transaction processing; and external legal advisors and auditors under strict confidentiality obligations. We do not transfer personal data to third countries without adequate protection guarantees in accordance with Article 37 of the LOPDP.
5. Data subject rights
In accordance with the LOPDP, you have the right to: access your personal data and obtain a copy thereof; rectify inaccurate or incomplete data; request the deletion of your data when it is no longer necessary for the purpose for which it was collected; object to the processing of your data in certain circumstances; request the portability of your data to another controller; and withdraw your consent at any time without affecting the lawfulness of prior processing.
6. Data security
We implement appropriate technical and organizational measures to protect your personal data against unauthorized access, loss, alteration, or disclosure. These measures include data encryption in transit and at rest, role-based access controls, continuous system monitoring, and periodic security audits.
7. Data retention
We will retain your personal data for as long as necessary to fulfill the purposes described in this policy and in accordance with applicable legal limitation periods. Financial and transactional data will be retained for a minimum of ten (10) years in compliance with Ecuadorian tax regulations.
